Patexia Releases Patent Litigation Intelligence Report 2026: Transforming Data into Strategic Advantage

Using its proprietary litigation data and analytics framework, Patexia extracts key patent litigation statistics and evaluates the full universe of attorneys, law firms, and companies participating in patent disputes. Rankings are based on measured activity, case outcomes, and performance, assessed separately for plaintiff-side, defendant-side, and overall participation.

Santa Monica, CA (January 29, 2025): Patexia, a leading provider of data-driven intellectual property analytics and intelligence, today announced the publication of its Sixth Annual Patent Litigation Intelligence Report, offering a comprehensive analysis of patent litigation activity across U.S. federal courts over the past five years.

As patent litigation activity continues to change in volume, venue, and outcomes, objective and comprehensive data have become key for understanding market dynamics and participant behavior. Covering 18,352 patent cases filed between July 1, 2020, and June 30, 2025, the report examines trends in litigation volume, venue selection, judicial assignment, technology focus, and case outcomes. Patent litigation activity experienced a sharp increase in 2025, reflecting a meaningful shift in litigation dynamics following earlier post-pandemic declines.

Key Findings of the 2026 Patent Litigation Intelligence Report:

  • 18,352 patent cases were filed during the study period
  • 17,811 unique patents were asserted across these cases, belonging to 523 distinct IPC codes, underscoring the broad technological scope of U.S. patent litigation.
  • 47,639 companies participated in patent disputes, appearing as plaintiffs, defendants, or in both roles, reflecting the scale and diversity of corporate involvement.
  • 3,047 law firms represented parties in District Court patent litigation, demonstrating widespread participation across the legal industry.
  • 14,197 attorneys, including local counsel, appeared on behalf of litigants, highlighting the extensive legal workforce engaged in patent enforcement and defense.

The report centers on comprehensive rankings of the top 1,000 attorneys, law firms, and companies in patent litigation, measured by activity, success, and overall performance. By separating rankings across plaintiff, defendant, and overall roles, the analysis offers actionable insights into litigation strategies and identifies the most influential participants across the patent ecosystem.
